This Service Agreement ("Agreement") is made and entered into by and between the Client and Clarily Creations ("Provider"). By proceeding to payment, the Client agrees to all terms and conditions outlined in this Agreement, effective as of the date of purchase.

  1. OVERVIEW OF SERVICES

Provider agrees to design and build a single-page website ("One-Page Hub") for the Client for a flat fee of $300. This service is designed to provide the Client with a clean, professional, and effective online presence quickly and efficiently.

  2. SCOPE OF SERVICES

The One-Page Hub service includes the following deliverables:

    • Design and build of a single-page website based on the information provided in the Client's intake form.
    • Integration of text, images, and branding elements supplied by the Client.
    • Setup of one (1) booking/payment page link (e.g., to Calendly, Stripe, Stan Store).
    • Implementation of hyperlinks and buttons to direct visitors.
    • One (1) round of reasonable revisions based on Client feedback.
    • Connection of the completed website to the Client's domain.
    • Mobile-responsive design.
    • Website hosting for the first full year included in the $300 fee.
  3. CLIENT RESPONSIBILITIES

The successful and timely completion of the One-Page Hub is dependent on the Client's cooperation. The Client agrees to:

    • Provide full payment of $300 prior to the start of the project.
    • Complete the intake form with all necessary information, copy, and images.
    • Purchase a domain name in their own name and with their own billing information. Provider will offer guidance but is not responsible for purchasing the domain.
    • Connect the website to their domain with Provider's step-by-step guidance and support.
    • Provide timely feedback during the review phase. Delays in feedback may impact the final delivery timeline.
  4. PROJECT TIMELINE & DELIVERY

The standard delivery timeline is 3 business days. This timeline begins only after the following conditions have been met:

    1. Full payment has been received.
    2. The completed intake form has been submitted.

Business Days Definition: Working days are Monday through Friday, excluding major US holidays. For example, if you submit your materials on a Friday afternoon, your site will be ready by end of day the following Wednesday.

  5. TRANSFER OF OWNERSHIP & ACCESS

This Agreement is structured to ensure the Client has full ownership of their digital assets from day one.

Domain Name: The Client will purchase and maintain full ownership and control of their domain name. Provider will not own or have primary access to the Client's domain.

Website Platform Access: Upon payment, the Client's email address will be immediately added as an "Editor" to the website project. This grants the Client direct access to their site during the build process and after launch.

Final Handoff: Upon final approval and launch, the project is considered "Live & Handed Over." At this point, the Client has full ownership of the website and the domain it is connected to. The Provider's primary role is complete.

    Ongoing Platform Fees & Hosting:

    • Year 1: Hosting and platform maintenance are included in the $300 fee.
    • Year 2 and Beyond: The Client is responsible for ongoing costs, which include:
      • Domain renewal fee (paid to the domain registrar)
      • Website hosting and platform subscription
    • Optional Support Plan: Provider offers a "$50/month Set & Forget" support plan that covers hosting, security, and a set number of minor monthly updates to ensure the Client's site always looks its best. This is optional; clients may alternatively upgrade to their own hosting account and manage it independently.

File Portability & Data Ownership: The Client retains full ownership of all content, including text, photos, and website code. Should the Client wish to relocate their website to another platform or provider at any time, Provider will download and deliver all website files to the Client. The Client may then rebuild their site using any platform of their choosing.

  6. REVISIONS & APPROVAL

Provider will provide the Client with a preview link to the website for review. The Client is entitled to one (1) round of revisions to request reasonable changes (e.g., text edits, image swaps, color adjustments). A "round of revisions" is defined as a single comprehensive list of requested changes. Additional rounds of revisions will be billed separately.

Once the Client gives final written approval (e.g., via email), the project will be considered complete and ready for launch.

  7. TERMINATION

By Client: If the Client chooses to terminate this Agreement before the project is complete, the $300 fee is non-refundable, as it covers the time and resources allocated upon payment.

By Provider: Provider reserves the right to terminate this Agreement if the Client is unresponsive for a period of 14 days or fails to provide the necessary materials (domain access, content) to complete the project. In such a case, the fee is non-refundable.

  8. LIMITATION OF LIABILITY

Provider's liability to the Client for any claim, loss, or damage arising out of this Agreement shall be limited to the amount of the fee paid by the Client. Provider is not responsible for website downtime, security breaches, or other issues related to third-party hosting or domain registrars once the project is handed over.

  9. ENTIRE AGREEMENT

This document constitutes the entire agreement between the Client and the Provider. By submitting payment for the One-Page Hub service, the Client agrees to all terms and conditions outlined in this Agreement.
